Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the MondialPay platform, APIs, websites, and services (collectively, the “Services”). By creating a MondialPay account or using the Services, you agree to these Terms.
1. Eligibility
You must be at least 18 years old and legally capable of entering a binding contract to use MondialPay. If you are using the Services on behalf of a business, you represent that you have authority to bind that business to these Terms.
2. Account responsibilities
You are responsible for maintaining the confidentiality of your API keys and login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorised access at security@mondialpay.com.
3. Acceptable use
You agree not to use the Services to facilitate illegal activity, to process payments for prohibited business types, to interfere with other users, or to bypass any security measures. We publish our Acceptable Use Policy in the MondialPay dashboard, and we reserve the right to suspend accounts that violate it.
4. Fees
Fees for the Services are listed on our Pricing page and in your dashboard. By using the Services, you authorise us to deduct applicable fees from your MondialPay balance or linked payment method.
5. Compliance and regulatory obligations
You are responsible for complying with all laws and regulations that apply to your business, including KYC/AML, sanctions, tax, and consumer-protection laws. MondialPay may request additional information at any time to meet our own regulatory obligations, and may suspend accounts where compliance risk cannot be verified.
6. Intellectual property
MondialPay retains all rights, title, and interest in the Services, including the platform, APIs, documentation, and trademarks. You retain ownership of your own data and content; you grant us a limited licence to use it solely to provide the Services.
7. Termination
Either party may terminate these Terms at any time. On termination, MondialPay will return any remaining balance less outstanding fees and chargebacks, subject to applicable regulatory holds.
8. Disclaimers and limitation of liability
The Services are provided “as is” and “as available”. To the fullest extent permitted by law, MondialPay disclaims all warranties and shall not be liable for indirect, incidental, or consequential damages arising from your use of the Services. Our total liability under these Terms is capped at the fees you paid us in the twelve months preceding the claim.
9. Governing law
These Terms are governed by the laws of England and Wales. Any disputes will be resolved in the courts of London, unless mandatory local law requires otherwise.
10. Changes
We may update these Terms from time to time. When we make material changes, we'll notify you by email or through the MondialPay dashboard at least 30 days before they take effect.
